BRAYH – Terms & Conditions



Nature of Services

BRAYH operates solely as an independent private aviation brokerage and service provider. BRAYH does not own, lease, manage, operate, or control any aircraft and is not an air carrier. All air transportation services are provided exclusively by licensed third-party aircraft operators holding valid Air Operator Certificates and operating under their own regulatory approvals. BRAYH’s role is limited to arranging charter services between the client and the selected aircraft operator.

Booking Confirmation

A booking is considered confirmed only upon written acceptance of the quotation and fulfillment of the specified payment terms. Upon confirmation of a booking, the air transportation contract is formed directly between the client and the aircraft operator. After booking confirmation, all operational matters, including flight scheduling, safety, crew, aircraft performance, delays, or modifications, fall under the responsibility and authority of the aircraft operator. BRAYH shall not be responsible for the performance of the operator, and all post-booking operational communication may be conducted directly between the operator and the client.

Pricing & Payment

Cancellations and changes

Cancellation terms are governed by the policies of the selected aircraft operator. The client acknowledges that cancellation penalties may range from partial charges to full charter cost forfeiture, depending on timing and aircraft type. BRAYH bears no responsibility for cancellation penalties imposed by operators and shall not be liable for any financial losses resulting from cancellation, schedule modification, or failure of the operator to perform.

BRAYH shall not be responsible for any cancellation, delay, aircraft substitution, technical issue, weather-related disruption, regulatory restriction, or operational decision made by the aircraft operator.

Passenger Responsibilities

The client and passengers are responsible for ensuring possession of valid passports, visas, travel documentation, and compliance with customs and immigration requirements. BRAYH shall not be liable for denied boarding or entry refusal due to documentation issues.

Concierge & Third-Party Services

BRAYH may arrange ancillary services such as ground transportation, catering, hotel reservations, or VIP handling upon request. Such services are provided by independent third-party suppliers with extra fees. BRAYH shall not be liable for the performance, failure, negligence, or acts of such third parties.

 Limitation of Liability



To the maximum extent permitted by applicable law, BRAYH shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to flight operations, including but not limited to personal injury, death, baggage loss, delay, missed connections, financial loss, reputational damage, or inconvenience. All liability relating to air transportation rests solely with the aircraft operator. In any event, BRAYH’s total liability shall not exceed the amount of its brokerage fee received for the specific booking.

Force Majeure

BRAYH shall not be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather, government restrictions, airspace closures, political unrest, pandemics, airport shutdowns, or acts of God.

Compliance & Right to Refuse Service

BRAYH reserves the right to request identification documents, conduct compliance checks, and refuse service at its discretion in cases involving regulatory concerns, safety risks, or anti-money laundering obligations.

Operational Authority


The aircraft operator retains full authority over flight safety, operational decisions, route planning, crew assignment, and regulatory compliance. The operator may delay, reschedule, or cancel a flight if deemed necessary for safety or regulatory reasons. BRAYH has no operational control over aircraft or crew and accepts no liability for operational matters.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
